Today SCOTUS ruled on what many have deemed the most pressing civil rights issue of our time: whether or not the Fourteenth Amendment can set limitations on gender and marriage. In other words, the Supreme Court ruled on gay marriage. The result was SCOTUS held States are required to license a marriage between two people of the same sex and to recognize a marriage between two people of the same sex when their marriage was lawfully licensed and performed out-of-State. Given the gravity of the decision and the impact it has on so many lives, many brands will want to "weigh-in" on the decision and celebrate with the masses. While everyone should celebrate the win associated with today's ruling, there were 379 organizations that urged the Supreme Court to strike down state bans on gay marriage. They didn't just talk the talk, they walked the walk with the 14 same-sex couples and 2 gay widowers that brought the case and friends of the court. For those organizations that lent their names and shared their practices to the fight leading up to this decision, they've made the issue well within the acceptable bounds of social conversation. If you run through the roster of big businesses that participated, they've not only lent their names to the brief, but most have done the work to ensure more inclusive work environments and employment practices. Before jumping on the bandwagon of the #LoveWins (or any) social conversation, check this yardstick: will you be marketing good or echoing the good the organization is actively doing inside of your workplace? It's important to understand this decision and the impact it has for employment and customers. Today the Supreme Court said that if a same-sex couple gets legally married in a state that recognize gay marriages, all other states must recognize the marriage as a ban against it violates the equal protection law. The impact this will have on benefits is obvious, but there's a different issue that will need to be addressed: there are 31 states, along with the Federal Government, that offer no explicit legal protections in the civil right statues for the LGBTQ community. Make no mistake: while this isn't a new fight, it is the next big battleground. Before speaking socially today, know where your company stands. If you aren't standing on the side of actively banning discriminatory hiring and employment practices, actively promoting an inclusive workplace and doing good.... don't take today as the opportunity to for your employer brand to "fake it before you make it."
